Returns and Right of Withdrawal - Soul Rebel E-Shop

The conditions applicable to a return, withdrawal or refund request depend in particular on the status of the buyer, the nature of the product, the country concerned and the mandatory law applicable to the contract.
1. Consumer customers (B2C)
The provisions concerning the statutory right of withdrawal set out below apply to customers who qualify as consumers, that is, natural persons acting for purposes outside their trade, business or professional activity.
For consumers benefiting from French law or from consumer protection rules applicable within the European Union, the rights provided by the legislation governing distance selling remain fully applicable.
For sales to countries outside the European Union, Soul Rebel E-Shop does not automatically extend French or European withdrawal rules, on a contractual basis, to all international destinations.
Any mandatory rights granted to the consumer under the law applicable to their order nevertheless remain fully reserved.
2. Professional customers (B2B)
Purchases made by a professional in the course of their business activities do not, in principle, benefit from the 14-day right of withdrawal applicable to consumers.
The return conditions applicable to professional orders are determined by the contractual terms applicable to the order, without prejudice to any mandatory legal provisions that may exceptionally apply.
Certain specific situations may benefit from particular statutory provisions. However, these do not constitute a general right of withdrawal applicable to all professional orders placed with Soul Rebel E-Shop.
3. Consumers' right of withdrawal
Where a statutory right of withdrawal applies to a distance sale, the consumer generally has a period of 14 days in which to notify their decision to withdraw, without having to provide any reason.
For sales of goods governed by French law, this period generally begins when the goods are received by the consumer or by a third party designated by the consumer, other than the carrier.
How to exercise your right of withdrawal

- After notifying us of your withdrawal, you have the period provided by the applicable regulations in which to return the goods. For sales governed by French law, this period is generally 14 days.
Condition of returned products
The consumer may handle the product to the extent necessary to determine its nature, characteristics and proper functioning.
The consumer may nevertheless be held liable for any reduction in value resulting from handling beyond what is necessary for this verification.
Whenever possible, the product should be returned complete, together with its accessories and its original packaging where this is still available.
Return shipping costs
Where permitted by the applicable regulations and provided that the consumer has been informed in advance, the direct cost of returning goods following the exercise of the right of withdrawal remains the responsibility of the consumer.
However, where a product is defective or does not conform to the contract and the applicable law requires the seller to bear the costs necessary to bring it into conformity, those costs will not be charged to the consumer.
Refund
Where the statutory right of withdrawal has been validly exercised, the refund is made in accordance with the conditions and time limits laid down by the applicable regulations.
For sales governed by French law, Soul Rebel E-Shop refunds the amounts due in accordance with the provisions of the French Consumer Code.
Where the applicable regulations provide for reimbursement of the original delivery costs, such reimbursement is limited to the cost of the standard delivery method offered by Soul Rebel E-Shop where the customer voluntarily selected a more expensive delivery method.
The refund is, in principle, made using the same means of payment as that used for the original transaction, unless another method is agreed which does not result in any additional cost to the consumer.
4. Exceptions to the right of withdrawal
The applicable regulations provide for certain situations in which the right of withdrawal cannot be exercised.
Depending on the nature of the product or service and the applicable law, this may include, in particular:
- products made to the consumer's specifications or clearly personalised;
- products liable to deteriorate or expire rapidly;
- sealed products which are not suitable for return for health protection or hygiene reasons once unsealed after delivery;
- certain audio or video recordings or software supplied on a physical medium once unsealed after delivery;
- certain digital content not supplied on a tangible medium where its supply has begun before the end of the withdrawal period under the conditions provided for by the applicable regulations.
Specific conditions applicable to digital products and downloads may also be stated on the relevant product page and during the ordering process.
5. Statutory guarantee of conformity - consumers
For sales governed by French consumer law, goods sold to consumers benefit from the statutory guarantee of conformity provided for, in particular, by Articles L217-3 and following of the French Consumer Code.
The seller is liable for defects of conformity covered by this guarantee which appear, in principle, within a period of 2 years from delivery of the goods.
Where a lack of conformity is established, the consumer is entitled to the remedies provided by law, including bringing the goods into conformity by repair or replacement where the statutory conditions are met.
Where repair or replacement is impossible, refused, carried out under conditions that do not comply with statutory requirements, or where the other conditions laid down by law are met, the consumer may benefit from the other remedies provided by law, including a price reduction or termination of the contract.
Consumers subject to another legal system retain any mandatory statutory guarantees applicable to them.
6. Defective, damaged or non-conforming products
If you receive a product that is defective, damaged or does not correspond to your order, please contact Soul Rebel E-Shop using the contact form and describe the issue encountered.
Photographs or other information enabling the defect to be identified may be requested where useful for processing your request.
Soul Rebel E-Shop will then inform you of the procedure to follow.
Where the applicable law requires the seller to bear the costs necessary to bring the product into conformity, those costs will not be charged to the consumer.
7. Returns from countries outside the European Union
Before returning any product from a country outside the European Union, please contact Soul Rebel E-Shop to obtain the instructions and return address applicable to your order.
The rights concerning returns, withdrawal, refunds and guarantees applicable to such orders may vary depending on the country and the law applicable to the contract.
Soul Rebel E-Shop does not automatically grant, for all international sales outside the European Union, a contractual right identical to the European 14-day right of withdrawal.
This provision does not limit any mandatory rights from which the customer may benefit under the law applicable to their order.
8. Return address and contact
Please do not return a product without first reviewing the conditions applicable to your request.
Where a product needs to be sent back, the appropriate return address will be provided to you in response to your request.
